In the following we inform you about the conditions under which consumers (hereinafter also referred to as “parents” or “legal guardians”) of Parkinson & Zylberberg GbR, ℅ Grosch Postflex 1316, Emsdettener Str. 10, 48268 Greven (hereinafter also “FamiLingua ”), A place for your child in a course is offered.
FamiLingua does not offer lessons for adults. The contract is concluded with the parents or legal guardians in order to enable the child specified when registering to participate in the selected course.
By registering with FamiLingua for a course or another service, you agree to be legally bound by these conditions. We therefore ask you to read the conditions carefully before submitting a registration to us.
For certain services provided by Parkinson & Zylberberg GbR, we may apply separate conditions, e.g. for registration or additions Conditions of participation, to which we refer in connection with the relevant services. The terms and conditions presented here do not lose their validity, but are only supplemented or expanded by the separate terms and conditions. In the case of competing provisions, the condition for the respective product applies.
The agreement remains in force until the student completes his / her training in accordance with the fee paid for him / her, or is either voluntarily cancelled by the parents or excluded due to a circumstance described in these terms and conditions.
The contractual partner is Parkinson & Zylberberg GbR, ℅ Grosch Postflex 1361, Emsdettener Str. 10, 48268 Greven. The contract language is German and German law applies.
2. Conclusion of the contract
Registration for regular courses takes place via our registration form, which we send to you by e-mail and which you complete, sign and return to us. A legally binding contract is only concluded with our confirmation by e-mail to the e-mail address you have provided. The participation fees listed in the reservation confirmation or the corresponding invoice are to be paid at the latest seven days before the start of the course or the date stated in the confirmation. The date of receipt of payment is decisive. FamiLingua reserves the right to cancel the booking and terminate the contract without further notice if the payment deadline is not met.
Registration for non-recurring or irregular events takes place by e-mail. Participation is only possible after timely payment of the amount shown on the invoice before the event. In the event of non-participation, there is no entitlement to a refund of the amount paid.
Contracts for school support are concluded by agreement via email and can include both fixed packages and individual services.
Contracts are concluded without fixed terms unless otherwise agreed in writing in advance. Details on cancellation can be found in Chapter 5.
3.1 Right of withdrawal
You have the right to cancel this contract within fourteen days without giving any reason. The cancellation period is fourteen days from the day the contract is concluded.
In order to exercise your right of withdrawal, you must inform us (Parkinson & Zylberberg GbR, ℅ Grosch Postflex 1316, Emsdettener Str. 10, 48268 Greven, firstname.lastname@example.org, Tel. +4915201023792) by means of a clear declaration (e.g. a with the Post, fax or e-mail) of your decision to withdraw from this contract. You can use the attached model withdrawal form for this purpose, but this is not mandatory.
To meet the withdrawal deadline, it is sufficient for you to send your notification of exercising your right of withdrawal before the withdrawal period has expired.
3.2 Consequences of Withdrawal
If you withdraw from this contract, we will have given you all payments that we have received from you, including delivery costs (with the exception of the additional costs that result from choosing a different type of delivery than the cheapest standard delivery offered by us have), to be repaid immediately and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you; In no case will you be charged any fees for this repayment.
If you have requested that the service should commence during the cancellation period, you have to pay us a reasonable amount, which corresponds to the proportion of the services already provided up to the point in time at which you informed us of the exercise of the right of cancellation with regard to this contract Compared to the total scope of the services provided for in the contract.

4. Prices and terms of payment
4.1 Price information & payment methods
Fees for regularly scheduled courses are to be understood as annual fees paid in 12 equal monthly rates. The amount of the rates depends on the price information on our website as well as in the reservation confirmation. If entry is made during a current teaching year, the annual fee is reduced by the part that has already passed, so the monthly instalment remains the same. If entry is made during a current teaching month, the fees for that month will be charged accordingly.
Fees for project days and other events are payable once.
All prices mentioned are final prices. In the sense of § 19 UStG no sales tax is charged and therefore not shown.
FamiLingua strives to keep the prices stable, but reserves the right to increase them at any time with a notice of at least 30 days if this is necessary to maintain our offer or to ensure the quality of our offer. Contributions that have already been paid are excluded from an increase. Should we adjust the price, we will send you a new registration form and re-conclude the contract. Accordingly, you have the right to terminate the contractual relationship by not accepting the contractual offer.
The responsibility for paying fees and other additional costs rests with the parent or guardian. If the agreed payments are not met, we reserve the right to block access to the lessons and to all resources immediately until the requirement has been met.
4.2 Guarantee of lessons/lesson cancellations
FamiLingua guarantees the provision of at least 36 lessons (units) per year if a course is booked once a week; at least 72 lessons per year are guaranteed if two units are booked per week. If a student joins the course during the current teaching year, he or she is entitled to the units that are still regularly offered.
Should the guaranteed number of units offered in a teaching year be undercut due to cancellation or other reasons for which FamiLingua is responsible, a pro rata refund of excess fees paid will take place.
4.3 Payment method
The first monthly payment must be received by us at least seven days before the start of the first month of classes or by the date stated in the confirmation of enrolment, and in the further course of participation by the 3rd working day of each month. The reservation of the place is forfeited if the payment is not received as agreed, and we have not been contacted for clarification at least seven days before the end of the payment period. We reserve the right to exclude students from lessons until full payment has been received.
4.4 Fees for project days and other events
Fees for project days and other events vary depending on the scope or duration and the effort involved. Payment must be received by us before the date of the event or by the date stated on the invoice in the amount stated there.
4.5 Fees for school support
Fees for school support result from the agreed scope of services and are payable before the service is provided. Certain services will be charged on a time basis if they exceed the initially agreed scope. Payment in installments corresponding to the partial services to be provided is possible by agreement.
4.6 Fees for individual and small group lessons as well as lessons for exam preparation
The fees for other types of lessons, e.g. individual lessons, depend on the type, scope and group size of the desired lesson and are determined by prior agreement.
4.7 Discount promotion "25% for a successful recommendation"
During the period of the discount campaign, the name of a person who is already a customer of FamiLingua can be entered on the enrolment form. The person named will receive a 25% discount on their next monthly fee after the new customer has signed a contract with a term of at least one month. For annual payments, the discount is calculated on a pro rata basis. The discounting of vouchers (5er-/10er-cards) is excluded. In the event of cancellation of the contract by the new customer, the entitlement to the discount shall also expire.
The discount can only be claimed once per month. If a person recruits several new customers, he or she will receive the discount per recruited person in each additional month of the contract period. Cash payment is excluded, even if the contract is terminated. It is also excluded to name more than one person as a recruiter on the enrolment form.
FamiLingua informs about the duration of the discount campaign on the website and reserves the right to terminate it at any time.
Beyond the statutory cancellation period, we allow cancellation within the first full month to the end of the same.
After the first full month, the contract can be terminated by either party with three months' notice until the end of a month. The annual premium is reduced accordingly by the amount that would be due for the further months.
FamiLingua reserves the right to a waiting period of 6 months for the conclusion of a new contract in the event of prior termination.
The termination can be made either by email to info @ familingua or by post to Parkinson & Zylberberg GbR, ℅ Grosch Postflex 1316, Emsdettener Str. 10, 46268 Greven. It must be in text form.
6.1 Responsibilities of the teachers
The parents authorize the FamiLingua teachers to act in the interests of the participating child in lessons and at other events that are the subject of the contract with FamiLingua. This applies in particular to the content, methods and social forms used by the teacher in the classroom.
If you have any suggestions regarding the lesson, please send us a completed feedback sheet. We are grateful for any constructive feedback, but we cannot guarantee that requests with regard to the lessons will be fulfilled by us. Pedagogical and didactic decisions are ultimately the responsibility of FamiLingua or the responsible teacher.
6.2 Giving lessons
We at FamiLingua will do everything we can, within the scope of our possibilities, to support every student in the best possible way, both pedagogically and didactically. However, we cannot guarantee that he / she will have a full command of the English language after completing the courses. The learning success is largely influenced by the willingness and ability of the student to make an effort.
In order to determine which course is appropriate for the child's language level, we carry out a placement test before starting the course. We expect you to accept this classification as it promises the best possible learning success.
FamiLingua currently does not hold any exams and does not assume any responsibility for the time or financial expenses incurred in connection with exams. If you want your child to take an exam, you will have to look for a suitable exam centre and register your child yourself. You will also have to bear the costs of taking exams yourself.
We will never post photos, videos and other posts that could violate the privacy of students on our website or on social media without parental consent. In our lessons, the children use the interactive teaching platform teech and can be seen and heard by the other course participants. In the interests of the privacy of students and teachers, it is strictly forbidden to make screen or audio recordings or screenshots during lessons. Lesson outcomes On so-called “boards”, material and work results are archived in the protected area of the platform exclusively for private purposes (follow-up to lessons, repetition). It is forbidden to pass on or reproduce the results of the lessons of others.
Parents and students undertake to adhere to the rules of conduct that can be found in the FamiLingua manual. The FamiLingua manual is available as a PDF.
In the event of violations, the teachers have the power to resolve the matter. Disciplinary measures ("educational measures") are for example
Verbal references to the wrongdoing
The muting during a live lesson, the withdrawal of opportunities for interactive participation (e.g. removal of the virtual pen)
In the event of gross violations or due to repeated bad, inappropriate or offensive behaviour by the students or parents, the exclusion from the live lesson
The final exclusion from the course and termination of the teaching contract.
6.5 Usernames and Passwords
Students are not allowed to share links, logins or social media access with other students. If students want to get in touch outside our classes, they have to do so through the FamiLingua team and the parents of the other student.
6.6 Security on the Internet
FamiLingua will take all necessary steps to ensure that your child uses the facilities of the virtual classroom for appropriate purposes. Deliberate abuse is treated as a violation of the FamiLingua rules and, in extreme cases, can lead to the exclusion of a student from our classes (see Section 6.4).
Students will use YouTube and other resources as part of the class. However, teachers will never point to content that is not for teaching purposes. It is the responsibility of parents to ensure that they have adequate content controls and internet security software in place to protect their child from inappropriate content.
The parents or legal guardians are also obliged to ensure that their child does not take any illegal actions during class. FamiLingua is not liable for legal violations that are committed by the student during or in connection with the class.
We cannot guarantee that students in non-European countries will always have access to European online content.
6.7 Learning environment
FamiLingua is only a supplement to full-time teaching in a regular school. The parents or legal guardians are fully responsible for the school education.
Parents or legal guardians are responsible for ensuring that their child has access to a place suitable for learning. FamiLingua is not responsible for this. Additional materials such as textbooks must be acquired independently if required.
Internet access and suitable technology (tablet, laptop or computer with camera and microphone) are required to participate in the class. The parents or legal guardians are responsible for the provision. Refunds will not be given if the internet connection is poor or if there is a problem with the device the student is using.
FamiLingua does not reimburse fees for missed appointments. The parents or legal guardians are responsible for the participation of the child. If students are unable to attend a live class, parents or guardians should notify the school by email or text message. If a student misses a live class, he / she will be expected to review the archived material from that class at a later date. There are also catch-up appointments at which missed content can be made up. There is no entitlement to a make-up appointment available for every missed appointment. Dates are set by FamiLingua and announced in good time.
6.8 Timetables, course sizes
FamiLingua creates the pupils' timetables before the pupil enters.
The requirement for the creation is, among other things, the guarantee of small courses. Information on the course sizes of the various levels can be found on the website. The quoted exchange rates are guide values, and we always strive to adhere to them. The actual number of participants may differ if this is necessary for organizational or economic reasons.
Requests with regard to the timetable can be communicated using the registration form. FamiLingua will endeavour to take these requests into account, but cannot guarantee it. The timetables are designed in such a way that overlaps between individual course groups are avoided. The timetable may change, in particular in order to be able to continue offering lessons in the event of unforeseen and prolonged absences of teachers.
6.9 School year, vacations, public holidays
The exact period of the teaching year is indicated on the website and on the registration form. We are based on the statutory holidays of the State of Berlin.
The units that take place beyond the number of 36 or 72 teaching hours are primarily intended for catching up on missed units, if there is a need to catch up. For this purpose, courses may be combined in exceptional cases, in particular in order to be able to accommodate scheduling requests. Catch-up dates will be announced by e-mail. If you wish your child to participate, you must inform us at the latest three days before the respective scheduled course date.
There are no classes on Berlin public holidays. Lessons cannot be guaranteed on bridge days in Berlin.
7. Observance and protection of copyrights and trademarks
Material used in lessons such as worksheets, pictures, etc. is protected by copyright and is intended exclusively for use in lessons or for private use. It is not permitted to pass on the materials used to third parties or to reproduce them.

9. Changes to the terms and conditions
Should we want or have to change these terms and conditions in whole or in part, we will inform you in advance of the planned changes. In this case, you have 30 days from the time of notification to notify us if you decline a change. If you do not make use of this, your consent to the changes is deemed to have been given. We will expressly inform you in the letter of amendment about the meaning of your silence and the deadline.
